ZONING BOARD OF APPEALS DRAFT MINUTES

July 22, 2019

 

 

Chairman William Moreau called the meeting to order at 7:00 p.m. and led the flag salute.

 

Chairman William Moreau welcomed everyone to the meeting and proceeded to review the Rules of the Board.

 

Zoning Clerk Linda McCabe called the roll: Chairman William Moreau � present, Clifford Hanehan � absent, Thomas Carringi � absent, Clarence Fosdick � present, Christopher Benn � present, Nicholas Schwartz - present, Steve Mehan - present, Alternate Mark Sullivan - absent.

 

Also present: Zoning Officer Gil Albert, Attorney William Reynolds and Steve Reuter. (Sign-in sheet is on file in the Clerk�s office.)

 

Prior to the approval of the minutes, there was a correction made at the request of a Board member.

Approval of Minutes: A motion was made by Clarence Fosdick, seconded by Christopher Benn, to accept the meeting minutes of June 24, 2019.�� Chairman William Moreau � aye, Clarence Fosdick - aye, Steve Mehan - aye, Christopher Benn - aye, Nicholas Schwartz - aye, Clifford Hanehan - absent, Thomas Carringi - absent.

Public Hearing for Area Variance

Location:25 Saratoga Lake Rd.

 

Applicant seeks a 15' front setback variance in order to construct a new house in the location of the house that burned down.

 

Steve Reuter appeared on behalf of the Applicant and reviewed the requested setback variance with the Board.He also noted the surrounding homes are all lined up along Fitch Rd. at the same setback and they'd like to do the same to keep in line with the homes around them.

 

Chairman William Moreau asked if there were any Board questions.

 

Christopher Benn questioned what they will do with the existing shed.

 

Steve Reuter responded the Applicant would like to leave it for storage and remove it once the house is built.

 

Christopher Benn suggested they remove the concrete pad in front of the shed and then move the house back 5'; they'd still have the views and just that 5' will help get it off the edge of the road a bit more.It would still be facing the lake, still within the 40' off of Rt. 9P, but a bit further off the lake road.He added the applicant's talking about removing the shed after the house is built, so if we get the house shifted back even that 5', it will be a benefit.After a brief discussion, the Board agreed.

 

Clarence Fosdick asked for the reaction of the Applicant's representative to this suggestion.

 

Steve Reuter stated leaving the shed there will make it harder for him to build.

 

Chairman William Moreau asked the opinion of the Zoning Officer.

 

Zoning Officer Gil Albert stated he's gone back a couple feet from the original already.He added he was under the impression the owner was keeping the old shed.If he leaves the shed, realistically he needs all the room he has there to excavate and do this.

 

After providing Proof of Notice in the Saratogian on July 12, 2019, Chairman William Moreau opened the Public Hearing at 7:12 p.m. asking those wishing to speak, to please stand and state their name and address.Seeing as no one wished to speak, Chairman William Moreau closed the Public Hearing at 7:13 p.m.

 

Chairman William Moreau then went through the Balancing Test, line by line, with the Board; the Board found in favor of the Applicant.

 

A motion was made by Christopher Benn, seconded by Clarence Fosdick, to approve a 10' variance, amending the application to a 30' setback.Chairman William Moreau � aye,Clarence Fosdick - aye, Steve Mehan - aye, Christopher Benn - aye, Nicholas Schwartz - aye, Clifford Hanehan - absent, Thomas Carringi - absent.

A motion was made by Nicholas Schwartz, seconded by Christopher Benn, to adjourn the
