Supervisor Robert Hall opened the regular meeting with the Pledge of Allegiance

at 8:11 p.m.

 

Roll call: Jean Casey, Town Clerk, called the roll. Supervisor Robert Hall- present, Councilman Bruce Cornell - present, Councilman Michael McLoughlin - present, Councilman Fred Drumm- present and Councilman Phil Griffen- present.

Approval of Minutes: All Board Members had read the minutes of the August 11, 2003 regular meeting. A motion was made by Councilman Philip Griffen and seconded by Councilman Fred Drumm that the minutes of August 11, 2003 be accepted as read. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

 

Town Clerk’s report: Fees paid to the County treasurer for Dog licenses $54.37. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $12.00. Fees paid to NY D.E.C. for hunting/fishing licenses $3,454.08. Fees paid to The State Health Dept. for marriage licenses $22.50. Dog license fees to Supervisor Robert Hall $152.13. Clerk fees to Supervisor Robert Hall $196.92. Total State, County, and Local Revenues received were $3,892.00.

 

Zoning Officer’s report: Robert Hathaway reported for August 2003: 7 Building permits, 20 Inspections, 2 Certificates of Occupancy. A check for $644.00 was given to Supervisor Robert Hall. Supervisor Robert Hall mentioned that the Nielson Road subdivision has been approved by NY State. They still need a $370,000 bond in order to put the road in and then the wells will be drilled and tested before any building permits are issued.

 

Supervisor’s report: Supervisor Hall presented August 2003 balances in Town funds as follows: General A $370,192.65, General B $60,279.25, Highway Outside $407,444.66, Youth Recreation & Services $2,489.84, Highway Equipment Reserve $130,350.03, Building Reserve $791,055.61 and Fire Protection $0.03. August revenues were $162,590.13 and expenses were $266,272.77. The total August balance is $1,761,812.07.

 

Highway: Grant Seymour, Highway Superintendent, said that the CHIPS projects are done. The crew is resurfacing the upper end of Wilbur Rd., and should be done by the end of the month. He stated that the new mower is working well. Grant Seymour requested to put out for bid: winter sand, type 4 gravel, low sulfur diesel fuel, and #2 fuel oil for the garage. The bids will be opened at the next meeting in October. Supervisor Robert Hall commented on the problem on Nielson Road with the beaver dam causing the culvert to be plugged up and the resulting flooding. He questioned whose responsibility it would be to remedy the situation? Town Attorney Bill Reynolds said it would be the property owner if it did not originate on the town’s right of way or if there is no drainage easement.

 

Landfill: No report.

 

Insurance: Supervisor Robert Hall stated that our insurance premiums are up just 8% to

$26,453. He mentioned that our insurance carrier, Adirondack Trust Insurance Agency, Round Lake Insurance Office, is requiring that the town adopt the procedures regarding Hiring, Termination, Suspension, Sexual Harassment, Medical Leave and Grievance Procedures of Saratoga County.

 

Youth Committee report: None

Buildings: No report.

 

Senior Citizens report: Councilman Bruce Cornell reported that the Schuylerville Seniors will be at the Rod & Gun Club on Wednesday and the Quaker Springs Seniors met today.

 

Park Committee report: Councilman Michael McLoughlin presented the board with the Town of Saratoga Recreation Park Site Selection Study prepared for the Park Committee by the LA Group for their review. He stated that the four sites had been narrowed down to one site and that there will be updates once the reports come back from the NYS Parks and Recreation Archeological Division. Supervisor Robert Hall made the motion for the board to go into Executive Session at 8:30 p.m., seconded by Councilman Michael McLoughlin. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0. The Executive Session ended at 8:50 p.m. and the regular meeting resumed. Councilman Michael McLoughlin proposed Resolution #03-32 and it was seconded by Councilman Bruce Cornell to authorize Supervisor Robert Hall to enter into an option agreement with the owners of the 59 acre Germain property, which was identified as the preferred site for a town park by the feasibility study, thereby granting the Town an option to purchase the parcel of land at a price of $135,000.00. In consideration of the option, the Town shall pay $5,000.00, which amount is to be applied toward the purchase price should the option be exercised. The option agreement shall provide for an exercise date of on or before April 1, 2004. After some discussion and questions by the board if all the studies that need to be done could be completed by April 1, 2004, the proposed resolution was amended to make the exercise date of the option agreement on or before one year from the date of agreement. The amended Resolution was offered by Councilman Philip Griffen and seconded by Councilman Fred Drumm. Roll call on Amendment: Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0. Supervisor Robert Hall noted that this project should qualify for the Saratoga County Open Space grant. Roll Call on Amended Resolution:

Councilman Michael McLoughlin announced that the Old Saratoga Mineral Water Association property will officially be turned over to the town for $10.00 and will become a Town Pocket Park. Attorney William Reynolds has a signed contract and will arrange for the survey work to be done.

 

Cable TV Committee: Councilman Fred Drumm and Town Attorney Bill Reynolds reported that information they had requested has not been received. The committee will continue to gather information and then will meet with the PSC and Time Warner Cable for negotiations.

 

 

Old Business: Councilman Michael McLoughlin proposed Resolution #03-33 to spend $1,000.00 for the Phase 1 survey of the proposed park site to determine the presence or absence of archeological sites or other cultural resources in the project’s area of potential effect. Councilman Fred Drumm seconded this. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0. It was noted that further surveys might be needed.

Having had the Public Hearing on the proposed Ambulance District, Map, and Plan, Councilman Philip Griffen proposed adopting the Ambulance District, Map, and Plan as set forth in Resolution #03-34 attached. It was noted that this resolution is subject to permissive referendum. Councilman Michael McLoughlin seconded the resolution. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

 

New Business: Supervisor Robert Hall noted that Elizabeth Koval’s appointment to the Board of Assessment Review would expire on September 30, 2003. Councilman Fred Drumm proposed Resolution #03-35 to reappoint Elizabeth Koval to the Board of Assessment Review for another 5-year term (10/01/03 – 09/30/08). Councilman Philip Griffen seconded this resolution. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

Supervisor Robert Hall stated a resolution is needed to transfer funds. Councilman Bruce Cornell proposed Resolution #03-36 to transfer $8,711.68 from Contractual Expense DB5110.4 to CHIPS DB5112.2. Highway will receive $73,411.68 from the State for CHIPS projects. Councilman Philip Griffen seconded the resolution. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

Supervisor Robert Hall having explained the need for the town to adopt the procedures of Saratoga County regarding Hiring, Termination, Suspension, Sexual Harassment, Medical Leave, Grievance Procedures, and anti-smoking policies for the Town of Saratoga’s Employee Manual as required by our insurance carrier asked for a resolution as such. Councilman Bruce Cornell introduced Resolution #03-37 adopting the previously stated Saratoga County procedures for the Town of Saratoga’s Employee Manual. Councilman Fred Drumm seconded this resolution. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

 

Communications: None

 

Privilege of the floor: Supervisor Robert Hall spoke on his dedication of the Saratoga County Supervisors’ Proceedings Book for 2002 to Alice Smith last month. She was very surprised and honored.

 

Audit the Bills: General A $6,287.01, General B $2,931.87, Highway Outside

$95,847.89, Building Reserve $861.30, Youth Recreation & Services $850.00, for a total expense of $106,778.07.
